Purpose and definitions
Café Kitsuné, a simplified joint stock company with a capital of €693,603.00, whose registered office is located at 9, rue du Helder, Paris, France, registered with the Registre du Commerce et des Sociétés [Trade and Companies Register] of Paris under number 7999 754 395, (hereinafter “Café Kitsuné”)
has developed a loyalty programme called “CAFÉ KITSUNÉ PARIS” (hereinafter referred to as the
“Loyalty Program” or the “Mobile Loyalty Card”) designed to reward customers who frequently buy items at Café Kitsuné locations that participate in the Loyalty Program, and that are located in metropolitan France and operated by Café Kitsuné.
Any reference to “we”, “us” or “our” in these Terms and Conditions means Café Kitsuné.
Any reference to “you”, “your” or “the Member” means you, as a member of the Loyalty Program.
These general terms and conditions of use (hereinafter the “GTC” or “General Terms and Conditions”) govern the Loyalty Programme and apply to all participants from the moment they join.
The Loyalty Programme is in place in all Café Kitsuné stores located in France.
A Café Kitsuné establishment consists of a coffee shop with the Café Kitsuné sign, and is exclusively dedicated to the sale of Café Kitsuné branded consumables and products.
How to join the Loyalty Programme
Joining the Loyalty Programme (hereinafter “Membership“) can be done at one of our Café Kitsuné locations, via the newsletters, or directly on the website preprod-m2.maisonkitsune.com/mk/fr/carte-fidelite-cafe-kitsune/. Membership to the Loyalty Programme is strictly free of charge and is not subject to any purchase conditions.
– at a Café Kitsuné location: simply scan the available QR code, then fill out and sign the Loyalty Program application form on your mobile phone;
– on the website: you can join by clicking on the “Register your card” tab and creating a personal account, via a computer, tablet or compatible phone.
When you join, you will be asked to provide a number of mandatory and optional details, as set out below:
– Favourite location,
– First name,
– E-mail address,
– Date of birth,
– Country of residence.
– Mobile phone number.
You will also need to indicate whether you wish to receive communications relating to Café Kitsuné brands, either by checking the box provided on the membership form or by expressly accepting it directly on your Mobile Loyalty Card (as defined below) after registering on the Site.
Your Membership is effective after registration of the card on your mobile, either in the “Wallet” on Iphone, or on your Android mobile device.
A notification confirming your Membership and the activation of your Mobile Loyalty Card will be sent to you following your registration, provided that you have entered your e-mail address.
Customers who, at the time of launch, were already registered in our customer base, will not be automatically registered as members of the Loyalty Programme.
Please note that as this is a joint loyalty programme between Café Kitsuné and the site. You will only be issued a single loyalty card with your email address as the identifier (hereinafter referred to as the “Mobile Loyalty Card“) regardless of the location where you purchase items.
It is your responsibility to keep your information up to date by changing it directly at your Café Kitsuné location or directly on your Mobile Loyalty Card. You guarantee the accuracy of all information provided and shall be solely responsible for any incorrect, incomplete or outdated information.
We cannot be held responsible in the event of non-receipt of an offer due to outdated, incorrect or incomplete information.
Conditions for joining the Loyalty Programme
The Loyalty Programme is only available to customers who are natural persons aged 16 and over. Minors aged 16 and over wishing to join the Loyalty Programme must obtain permission from their legal representative. Café Kitsuné reserves the right to request proof of this at any time.
Membership is strictly personal, only you can benefit from the advantages described below.
Use by any third party is prohibited and will not be accepted by any waiter/vendor when presented at the till.
You can only hold one Mobile Loyalty Card. In this respect, and in the event that an e-mail address or
a mobile phone number is associated with more than one loyalty card, we have the right to merge these loyalty cards into a single Mobile Loyalty Card. Under these conditions, the points still valid will be added together.
Your loyalty space
You will have access to your Mobile Loyalty Card no later than twenty-four (24) hours following the start of your Membership. In order to access your Mobile Loyalty Card, you will need to enter your email address and the password that you registered when you joined.
This space will allow you, in particular:
– to access your account,
– to check your loyalty status and progress,
– to change your personal information,
– to be informed about the latest news regarding the Loyalty Programme,
– to view and access your benefits.
User’s personal information
The personal information communicated by the Member within the context of the Loyalty Programme is strictly confidential and for the exclusive use of the Kitsuné group, comprising of the companies Café Kitsuné, Kitsuné France, and Kitsuné Musique, in its capacity as data controller, for the sole purpose of the operation of the Loyalty Programme, and in order to inform the Member, subject to his/her explicit consent, of the privileged offers of the group’s brands. As such, they will be kept for a period of three (3) years after the last active contact with the Kitsuné Group.
Pursuant to the amended French Data Protection Act of 6 January 1978, and the European General Data Protection Regulation of 27 April 2016 no. 2016/679, the Member has the right of access, rectification, deletion, portability, limitation, and opposition with regards to the processing of data relating to him/her, as well as the right to define directives relating to the future of his/her data after his/her death, with the Kitsuné group and for the duration of the existence of the Loyalty Programme, by writing to [email protected]; or by post to the following address Café Kitsuné, Legal Department/Personal Data Controller, 9, rue du Helder 75009 Paris (France). Members wishing to exercise their rights must send their request together with a copy of an identity document.
The Member may withdraw his/her consent at any time and lodge a complaint with a supervisory authority.
Members who exercise their right to delete, limit or oppose the processing of their personal data will be deemed to have waived their use of the Loyalty Program.
How the Loyalty Programme works
The Loyalty Programme provides for three (3) loyalty statuses, namely:
– level 1 “Latte” status (hereinafter “Latte Status”),
– level 2 “Chaï” status (hereinafter referred to as “Chaï Status”),
– level 3 “Dark Coffee” status (hereinafter “Dark Coffee Status”),
Latte Status is obtained upon membership, while Chaï and Dark Coffee Status are only available if a certain number of Loyalty Points have been accumulated.
– Loyalty Point Accumulation
Regardless of your status, you must present your Mobile Loyalty Card (and any additional mandatory identification, if applicable) when paying at a Café Kitsuné location.
You will earn one loyalty point (hereinafter the “Loyalty Point”) per visit, indiscriminately, it being specified that the scale for obtaining loyalty status is freely defined by Café Kitsuné which may, at any time, and at its sole initiative, modify it. In the event of a change, you will be informed of the new scale by any means we deem appropriate and useful, such as, but not limited to, posting in Café Kitsuné locations or updating the General Terms and Conditions on the Site and on your Mobile Loyalty Card.
The loyalty points earned will be added to your Mobile Loyalty Card within minutes of the visit. All points are valid for one (1) year from the date they are added to the Mobile Loyalty Card.
You may re-resister a receipt that has not been charged to your Mobile Loyalty Card by visiting a Café Kitsuné location within sixty (60) days of the purchase date with the corresponding receipt. Subject to the above, we will then credit your Mobile Loyalty Card with the relevant Loyalty Points.
– How do you move to higher statuses?
Membership of the Loyalty Programme gives you access to Latte Status. To move from one status to another, you must accumulate a certain number of Loyalty Points over a period of twelve (12) consecutive months, which is the period of validity of the Loyalty Points, without any other conditions, the move to each status remaining free.
Thus, to move:
– to Chaï Status, you must accumulate at least ten (10) Loyalty Points, i.e. ten (10) Visits over a period of twelve (12) consecutive months;
– to Dark Coffee Status, you must accumulate at least twenty (20) Loyalty Points, i.e. twenty (20) Visits over a period of twelve (12) consecutive months;
– The change of status
When a new status is accessed, a notification will be sent to your mobile phone, provided that you have accepted the sending of notifications.
Access to a new status is valid for a fixed period of twelve (12) months, starting from the day of the change of status. You will then benefit, for this period, from the specific advantages of this status, as described below.
To maintain the status you have acquired, you must accumulate, at least each year, the number of Loyalty Points indicated above.
In the event that this number is not achieved, you will, de facto and without your being able to oppose it at the end of the twelve (12) months, regain Latte Status, or the status that corresponds to the number of points accumulated over the course of these twelve (12) months, without any further information.
Please note that you will be notified one (1) month before the expiry of the current level.
Access to the different statuses will be possible again at any time, when a sufficient number of Loyalty Points is accumulated over a period of twelve (12) months, under the same conditions as those previously indicated.
Please note that with each change in status resulting in the issuance of the associated Café Kitsuné gift, your points balance will not be deducted from the number of Loyalty Points required to achieve that status, as the accumulation of Loyalty Points will continue.
In addition, and in the event that your Loyalty Points accumulation allows you to access two
loyalty status simultaneously, we inform you that you will then only be entitled to receive the Café Kitsuné gift corresponding to the highest status, and not two Café Kitsuné gifts, which you expressly accept.
Benefits of the Loyalty Programme
The Loyalty Programme allows you to benefit from privileged offers, as described below, depending on your status.
– Latte status:
The Latte status does not confer any loyalty benefit.
– Chaï status:
The Chaï status allows the Member to benefit from a free drink, from his/her tenth visit. This benefit is valid for fifteen (15) days from the date it is obtained.
– Dark Coffee status:
The Chaï status allows the Member to benefit from a pastry, from his/her twentieth (20th) visit as well as a “Café Kitsuné” tumbler, from his/her fortieth (40th) visit. These benefits are each valid for fifteen (15) days from the date they are obtained.
– Birthday offer:
The Loyalty Programme allows the Member to receive a birthday gift, valid for thirty (30) days from his/her birthday, provided that this date has been correctly entered in his/her Customer Account.
Conditions for obtaining Café Kitsuné gifts
As soon as the conditions for obtaining a Café Kitsuné gift are met, you will be informed by a notification on your mobile device.
To collect your Café Kitsuné gift, you will need to visit a Café Kitsuné location in France and present your Mobile Loyalty Card so that it can be scanned by Café Kitsuné staff.
We accept no liability for any loss arising from or in direct connection with the services or benefits provided or not provided under the Loyalty Program.
The Loyalty Program is a program designed to provide benefits to Members based on the number of visits to Café Kitsuné locations and requires that the Member abides by the General Terms and Conditions and behaves in a manner that is fair to Café Kitsuné and respectful of the Café Kitsuné brands.
(i) any breach of the General Terms and Conditions;
(ii) any fraudulent use by the Loyalty Program Member or any third party acting on behalf of the Member;
(iii) any act intended to disrupt the Loyalty Programme;
will result in the cancellation of all Loyalty Points and the deactivation and deletion of the loyalty account without compensation or indemnity of any kind.
We reserve the right to carry out checks on compliance with the General Terms and Conditions at any time
Deactivation of the loyalty account
If you do not make any purchases for a consecutive period of thirty-six (36) months, the Mobile Loyalty Card may be deactivated. We will then inform you by email (provided we have your email address) that if you do not make a purchase within thirty (30) days of receiving the email, your Mobile Loyalty Card will be permanently deactivated, without compensation or indemnity of any kind.
Modification or termination of the loyalty programme
The fact that one of the parties does not act under the General Terms and Conditions does not constitute a waiver of the right to act, unless this is expressly waived in writing.
These General Terms and Conditions are available in English and French.
These General Terms and Conditions apply from 27 July 2021, and will de facto replace any previous Terms and Conditions that were in force, without you being able to hold us responsible.
The mere fact of joining the Loyalty Programme implies full and unreserved acceptance of the General Terms and Conditions.
The General Terms and Conditions are governed by French law. If any provision of these General Terms and Conditions is held to be invalid, void or unenforceable for any reason, such provision shall not affect the validity and enforceability of the remaining provisions of the General Terms and Conditions.
